BOOKINGS, PASSES & MEMBERSHIPS

Conditions

  1. All bookings are made with The Ledge Trading Co. (The Gym/Ledge)
  2. In agreeing to this booking, you are confirming that you have read and accepted the statement below on behalf of everyone involved in the group (please consider what you need to say to group participants, or parents, in order that they understand the risks). The group will be given a safety briefing before beginning their activity.
  3. Climbing and Mountaineering are hazardous activities with a danger of personal injury or death. Although we take every care to minimise these risks, participants of all courses should be aware of and accept these risks and be responsible for their own actions and involvement. Indoor climbing is a very safe branch of this sport however some risks associated with activity at height remain. In addition, climbing is a physical activity and minor sports injuries (bumps, sprains, and strains) are not uncommon. Although we take every care to minimise these risks, parents and carers should be aware of these and accept them on behalf of their children.
  4. Neither The Ledge nor any of its representatives will be responsible for any illness, injury or death sustained on our courses, nor will they be liable for any uninsured losses of client property.
  5. Under 18’s wishing to participate in adult courses must, in the first instance, contact the centre to discuss requirements and eligibility. Please note additional consent forms may be required.
  6. All Ledge courses can be booked via The Ledge website or at reception. In order to reserve a place on a course you must complete an online booking. Course fees are payable via the website with a credit or debit card or during normal office hours.
  7. On receipt of a booking The Ledge will email booking confirmation together with joining instructions and an equipment list when appropriate.
  8. If your Company or Authority requires an invoice for this course, please contact The Ledge via admin@theledgeinverness.com Payment terms for invoices are strictly 30 days net from the date of invoice.
  9. Under the Late Payment of Commercial Debts (Interest) Act we reserve the right to impose interest on all invoices where the balance has not been settled in full within the specified credit period. Interest will be charged at 8% above the Bank of England base rate and will accrue on a daily basis. An administrative fee of £40 for debts up to £999.99 and £70 for debts above £1000 will also be levied on any outstanding balances.
  10. You must notify us of any medical conditions (e.g. asthma, epilepsy, diabetes, previous injuries), medication taken or allergies (i.e. penicillin, nuts) which may affect your ability to safely participate in any activities booked through The Ledge.
  11. You must notify us of any additional needs which may affect your ability to safely participate in any activities booked through The Ledge
  12. Our instructors reserve the right to ask one or more participants to leave a session if they are unable to participate appropriately in the activity, or if it comes to light that the participant is underage. These participants will be returned to the care of the group leader or accompanying adult for the remainder of the session and will no longer be under our care and responsibility.
  13. Sessions start and finish at the times stated on the booking and include any safety briefing and equipment set-up as well as any debriefing and equipment return. We reserve the right to refuse admittance onto the course/session if the participants arrive late and the course/session has already started. In the case that the participant or the group turn up after the start time of the session, the session will still finish at the designated time unless otherwise agreed with the instructor/bookings manager in advance; depending on how late your arrival will depend on whether you will be permitted to continue with the session. If you believe you will be late you must notify the centre at your earliest convenience.
  14. When making your booking you must have read and understood these terms and conditions, particularly those applying to cancellation, and agree to abide by them.
  15. All The Ledge bookings must be paid no later than 5 days prior to the session start date/time.
  16. Cancellations, transfers, and amendments within 5 days are subject to costs as described below. 

Cancellation by Client

  1. If a customer cancels before the 14-day notice period, they will receive a 75% refund. 
  2. If a customer cancels between 5 days and 48 hours prior to the start time, they will remain liable for 50% of any costs. 
  3. If a customer cancels within 48 hours of the start time, they will remain liable for 100% of any costs. 

Transfer request

  1. Outside of the 5-day notice period, a customer can choose to transfer to an alternative course date free of charge.
  2. If a customer wishes to transfer to an alternative course date within the 5-day notice period but 48 hours prior to the start time, they will incur an administration fee of £10.00.
  3. If a customer wishes to transfer to an alternative course date within 48 hours of the start time, they will remain liable for 50% of course costs. 

Ongoing block bookings (e.g., NIBAS, NICAS)

All payments for block bookings must be made in advance or invoice information provided in advance. All cancellations and transfer requests must be made by email and will be effective from the date of receipt by The Ledge.

If the course has not yet started:

  1. Outside of 48 hours a full refund or transfer of booking at no cost.
  2. Within 48 hours no refund will be provided.

If the course has started:

  1. No refund for sessions that have passed.
  2. We will look to transfer the sessions or refund the cost of the remaining sessions. 

Ongoing block bookings (GCSE, youth and school group bookings)

All costs for block bookings must be made in advance or invoice information provided in advance. All cancellations or amendments to bookings must be made by email and will be effective from the date of receipt by The Ledge. Amendments are subject to availability.

Cancellation by Client

  1. If a customer cancels outside of the 14-day notice period, they will receive a full refund. 
  2. If a customer cancels any booked sessions within the 14-day notice period, they will remain liable for all instructor costs within that 14-day notice period.

Amendment to booking by Client

  1. A customer can amend any sessions that aren’t within the 14-day notice period free of charge.
  2. If a customer wishes to amend any sessions within the 14-day notice period, they will remain liable for all instructor costs within that 14-day notice period.

Cancellation by The Ledge/Gym

  1. The Ledge will make every attempt to ensure that courses run, however, The Ledge reserves the right to cancel a course if there are insufficient numbers. In such a case The Ledge will notify the client as soon as possible but not less than 5 days prior to the commencement of the course.
  2. There may be circumstances outside the control of The Ledge such as (staff sickness or unforeseen emergencies) that would require The Ledge to cancel sessions with less than 24 hours notice.
  3. In the event of The Ledge cancelling a course the client shall be entitled to one of the following:
    1. A full refund of all payments made to The Ledge
    2. A transfer of all costs to an alternative course

Insurance

  1. The Ledge is fully insured for employers’ and public liability only and will not be liable for any losses of client property, illness or injury. Clients may wish to consider taking out insurance against accident and personal injury as well as cancellation and curtailment of courses (particularly for outdoors).

This needs to cover the activities that clients will be undertaking in their course. Such insurance may be obtained from: British Mountaineering Council (BMC), 177-179 Burton Road, Manchester M20 2BB, Tel: 0161 445 6111, or online from www.thebmc.co.uk. Group leaders/teachers remain in ‘loco parentis’.

  1. Group leaders/teachers are responsible for the behaviour of the group.
  2. Pre-existing medical problems or medication that may impact your climbing must be disclosed to the Instructor or Duty Manager before the activity starts.
  3. The correct clothing and footwear must be worn as advised by the instructor. Instructors reserve the right to remove participants from the group if they do not have the appropriate attire.
  4. The consumption of alcohol or the use of recreational drugs is strictly forbidden and anyone found to have consumed alcohol or drugs will be removed from the session. No refund will be offered.
  5. The Ledge may take photos of sessions for use on promotional material and media. If you wish to opt out of this, please let us know at reception or by email prior to arrival at admin@theledgeinverness.com
  6. Unless agreed otherwise, all children must be a minimum of 5 years for only bouldering sessions and 6 years of roped/bouldering sessions.

EFT Billing, Monthly Passes & Memberships – “Electronic funds transfer”

Electronic funds transfer (EFT) is a term that includes a wide variety of electronic payments, like credit card payments, ACH payments, and wire transfers.

EFT Billing

  • EFT passes entitle the purchaser to unlimited access to The Ledge for the duration of the pass validity.
  • EFT passes are billed monthly, on the first of the month by our card processor Stripe, card details are stored securely with Stripe and are not accessible to The Ledge or its staff.
  • A pro-rata amount must be paid at the time of starting the contract to cover the number of days between the date of sign-up and the first of the next month.
  • There is a minimum pass duration of one monthly billing cycle.
  • Passes can be bolted together to cover as many additional users as desired to create a fully tailored subscription.

Freezing

  • EFT passes can be frozen for durations of 2 complete months in any 12 months period at no extra cost. These can be taken consequently or in two one months periods. Freezes longer than 2 months may incur an admin charge. In normal circumstances, you may only start a freeze from the next billing date, any unused time between the freeze date and the next billing date will be forfeited.
  • Where a freeze is required due to reasons beyond the control of the customer and The Ledge (eg., coronavirus lockdown) customers will be credited for any unused value paid prior to the freeze date. This credit may be used in The Ledge against future dues or purchases but is otherwise non-refundable.
  • Freezing EFT does not extend the duration of the pass but simply holds the card details on file in order to simplify restarting monthly billing at the end of the freeze period.
  • Only 2 freezes in any one calendar year may be used.
  • Freeze requests must be sent via our online memberships page.
  • The Ledge reserves the right to not accept freeze requests.
  • The Ledge reserves the right to freeze passes at any time due to enforced/necessary closure. It also reserves the right to unfreeze these passes on the day of reopening following the enforced/necessary closure.

Cooling Off Period & Refunds

  • A full refund will be given if a customer has not used their pass and decides they no longer want the pass within the first 14 days. If within that time, the pass has been used a full price, peak time entry for every visit will be deducted from the refund.

Cancellations

  • EFT may be cancelled at any time after the first monthly billing is processed.
  • No refund will be given for partially used months.
  • Cancellation requests must be received no later than the first of the month to be applied before the next billing cycle, otherwise, the pass will be cancelled after the next billing has been processed. No refund will be given in this case.
  • Cancellation requests must be sent to admin@theledgeinverness.com

Missed Payments

  • From time to time a card may have insufficient funds or be expired. In these circumstances you will be notified automatically of the failed billing and an unpaid invoice will be raised on your membership account.
  • Customers may update their billing card if necessary, by contacting admin@theledgeinverness.com
  • A second attempt at automated billing will occur one week later.
  • If the second billing is unsuccessful the account will be frozen until the unpaid dues are cleared by the customer or a cancellation is requested.
  • Customers with a history of missed payments may be exempted from future monthly billed membership.

10 for 9 memberships

  • 10 for 9 memberships entitle the purchaser to a certain number of entries at a guaranteed cost saving.
  • The Ledge may change the cost of Punch Cards at any time, but valid Punch Cards will not be affected.
  • Punch Cards have an unlimited validity date.
  • Punches are non-refundable or transferable to other members.

10 for 9 memberships Cooling Off Period & Refunds

  • A full refund will be given if a customer has not used their pass and decides they no longer want the pass within the first 14 days.

10 for 9 Cancellations

  • No refund will be given for part-used 10 for 9 memberships after the 14-day cooling off period.
  • Unused punches may not be transferred to another customer, unless part of a gift purchase and agreed as such by The Ledge.
  • Cancellation requests must be sent to admin@theledgeinverness.com

Monthly Passes

  • Prepaid passes entitle the purchaser to unlimited access to The Ledge for the duration of the pass validity.
  • The prepaid pass has a fixed start and end date, which can be selected by the customer.
  • Passes are sold in one-month and one-year increments.
  • Passes can be bolted together to create a duration of as many months as the customer up to a maximum of 60 months.

Monthly Pass Change Requests

Freezing monthly passes

  • Prepaid monthly passes cannot be frozen.

Cooling Off Period for Monthly Refunds

  • A full refund will be given if a customer has not used their pass and decides they no longer want the pass within the first 14 days. If within that time, the pass has been used a full price, peak time entry for every visit will be deducted from the refund.
  • Cancellation requests must be sent to admin@theledgeinverness.com
